NURSULTAN NAZARBAYEV SIGNED THE DECREE ON THE CONCEPT OF LEGAL POLICY OF KAZAKHSTAN FOR THE PERIOD OF 2010 – 2020

Over the last years in the framework of “The Concept of Legal Policy of Kazakhstan for the period until 2010” there was adopted a number of important legislative acts to promote further development of the state and social institutions to ensure sustainable social and economic development of Kazakhstan. As a result, realization of “The Concept until 2010” has significantly improved Kazakhstan’s national legislation.

The first decade of the 21st century marked with implementation of Constitutional amendments proposed in Kazakhstan under the constitutional reform carried out to modernize political system and power division, and to enhance the role of the Parliament of Kazakhstan.

However, fundamental changes under globalization process in the world economy and politics as well as the internal development of Kazakhstan demand introduction of new approaches to the national legislation system including further improvement of regulatory and enforcement activities of the state.

“The Concept of Legal Policy for the period from 2010 to 2020” includes implementation of such provisions as:

- Ensuring the interaction with confessions, protection of freedom of religion through effective state’s policy in this area;

- Further development of specialized institutions dealing with protection of human rights and freedom;

- Development of human capacity and strengthening institutions of civil society;

- Improvement of a status of non-governmental organizations providing national support for social associations, development of civil initiatives;

- Legal support for administrative reforms aimed at creating an efficient and compact state apparatus, introduction of new management techniques, improvement of administrative procedures;

- Simplification of registration, permission and licensing procedures;

- Development of a clear concept of power separation between the court and extra-judicial bodies on the cases of administrative violations;

- Tax legislation must correspond with the industrial and innovation strategy of Kazakhstan to promote non-extractive sectors of economy and introduction of new technologies;

- Customs legislation must ensure simplification and harmonization of customs procedures to promote international trade and cooperation;

- Ensuring the modernization of financial control;

- Providing the legal framework for effective public policy in the sphere of natural monopolies and regulated markets;

- Improvement of the environmental legislation.

It is planned that carrying out “The Concept of Legal Policy for the period from 2010 to 2020” will allow to implement the main ideas and principles of the Constitution of Kazakhstan in the context of new phase of development of Kazakhstan.

Comprehensive development of Kazakhstan's legislation in accordance with “The Concept of Legal Policy for the period from 2010 to 2020” will contribute to strengthening the rule of law, protecting constitutional and human rights to ensure sustainable social and economic development of Kazakhstan as well as its statehood.
